These Terms of Use ("Terms") govern your access to and use of AshMap, owned and operated by Faedaway M.G. LLC ("AshMap," "we," "us," "our"). By accessing or using AshMap — whether through our mobile app, website, or any related service — you agree to be bound by these Terms. If you do not agree, do not use AshMap.
These Terms also serve as the End User License Agreement (EULA) for the AshMap iOS application available on the Apple App Store.
By creating an account, downloading the app, or browsing ash-map.com, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. If you are using AshMap on behalf of a business, you represent that you have authority to bind that business to these Terms.
AshMap is a cigar reference, collection, and business-directory platform intended solely for adults. You must be at least 21 years of age to use AshMap. By using the app, you represent and warrant that you meet this requirement and that you will comply with all applicable local, state, and federal laws governing tobacco products in your jurisdiction.
AshMap does not sell tobacco products. AshMap provides reference information and a business directory for cigar retailers and their customers. Any decision to purchase tobacco products is made entirely between the user and the merchant.

Merchants who claim or manage a shop profile on AshMap accept additional responsibilities:
AshMap reserves the right to remove, modify, or hide any merchant content that is inaccurate, misleading, or in violation of these Terms, without prior notice.
You retain ownership of any content you upload to AshMap, including photos, notes, check-ins, and reviews ("User Content"). By uploading User Content, you grant AshMap a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that content within the AshMap platform and related services for the purpose of operating and improving AshMap.
You may not upload content that you do not own or have the right to use. You may not upload content that infringes any copyright, trademark, privacy right, or other right of any person or entity. AshMap may remove User Content that violates these Terms at any time.
All software, design, branding, logos, trademarks, AI systems, algorithms, copy, and content that make up AshMap — excluding User Content — are the exclusive property of Faedaway M.G. LLC or its licensors. All rights are reserved.
You may not copy, reproduce, modify, distribute, transmit, display, perform, publish, license, create derivative works from, or sell any part of AshMap without prior written permission from Faedaway M.G. LLC.
AshMap provides AI-assisted tools for merchants including inventory recognition, cigar identification, and marketing content generation. These features are provided as convenience tools to assist merchants in managing their profiles and communicating with customers.
AI-generated suggestions — including product descriptions, social captions, promotional copy, and inventory classifications — are not guaranteed to be accurate, complete, or suitable for any particular purpose. Merchants are solely responsible for reviewing and approving all AI-generated content before publishing it.
AshMap makes no warranty regarding the accuracy of AI-assisted cigar identification, inventory matching, or any other AI output. Merchants should verify all AI suggestions against their actual inventory and brand guidelines before use.
AshMap offers auto-renewing subscription plans for both merchants and consumers.

Apple In-App Purchase billing: Subscriptions purchased through the AshMap iOS app are billed through Apple. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time by going to:
Refunds for in-app purchases are handled by Apple in accordance with Apple's refund policies. AshMap does not process refunds for purchases made through the Apple App Store. To request a refund, visit reportaproblem.apple.com.
If a free trial is offered, any unused portion of the free trial period is forfeited upon purchase of a subscription. Subscription prices may vary by plan, region, and promotional offers. Pricing is displayed clearly before purchase confirmation.
Web billing: Web-based merchant subscriptions are billed through Stripe. Web subscribers can manage their subscription through the AshMap merchant dashboard.
AshMap reserves the right to change subscription pricing at any time. Any pricing changes will be communicated in advance and will apply to renewals after the change takes effect. Active subscriptions continue at their current rate until they are canceled or renewed.
Applicable taxes may be added to subscription charges depending on your location and applicable law. Taxes are calculated and collected by Apple (for App Store purchases) or Stripe (for web subscriptions).
AshMap is provided "as is" and "as available" without warranties of any kind, express or implied. Faedaway M.G. LLC makes no guarantees regarding:
To the maximum extent permitted by law, Faedaway M.G. LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use AshMap. Always confirm details directly with the merchant before visiting.

AshMap is not responsible for the practices, content, or availability of any third-party service. Your use of those services is governed by their respective terms.
Your use of AshMap is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes how we collect, use, and protect your personal information. By using AshMap, you consent to our data practices as described in that policy.
AshMap may suspend or permanently terminate your account, with or without notice, if we determine that you have:
Upon termination, your right to use AshMap immediately ceases. Sections of these Terms that by their nature should survive termination — including intellectual property, limitation of liability, and governing law — will continue to apply.
AshMap may update these Terms from time to time. When we make material changes, we will update the date at the top of this page. Continued use of AshMap after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of AshMap.
